I, the undersigned participant or parent/guardian of the participant, understand and acknowledge that Kid’s Town Play Museum LLC is an indoor dramatic playhouse, not a daycare facility. I am aware that while participating in activities at Kid’s Town Play Museum, there may be inherent risks and dangers associated with these activities. These risks and dangers may include, but are not limited to, accidents, injuries, and the potential for harm.
I hereby agree, for myself and on behalf of my minor child(ren), to release, waive, discharge, and covenant not to sue Kid’s Town Play Museum LLC, its owners, employees, agents, representatives, and owner of the property of 5011 Rogers Ave in Fort Smith, Arkansasfrom any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my child(ren) while participating in activities at the Museum or on the Museum's premises.
I understand and agree that this waiver of liability includes, but is not limited to, any claims for personal injury, property damage, or any other harm, whether caused by the negligence of the Museum or otherwise.
I understand that the Museum does not provide childcare services and that it is my responsibility as a parent or guardian to keep a close and watchful eye on my child(ren) while they are on the premises of Kid’s Town Play Museum.
I further agree to indemnify and hold harmless the Museum from any loss, liability, damage, or costs, including attorney's fees, that the Museum may incur due to my or my child(ren)'s actions or behavior while at the Museum.
I have read this liability waiver, and I fully understand its terms. I understand that I am giving up substantial rights by signing this waiver, and I do so voluntarily.
By making a purchase, I acknowledge I have read and agree with this release and waiver of liability agreement in its entirety. Unless approved in writing by an authorized representative of Kid’s Town Play Museum, no alterations to this liability release/waiver form shall be valid, regardless of when such alterations were added.
By making a purchase, I certify and represent that I am the parent or guardian of the child or children who shall be entering the Kid’s Town Play Museum facility, and on his or her behalf, and my own behalf, have read this release and fully understand and voluntarily agree to all the terms and conditions set forth herein.
